California to Enforce Overlooked Property Tax Law as a Source of Revenue

According to Foreclosure Radar’s newsletter, one of their real estate predictions will soon have an impact on your tax return.

At the end of 2010, Sean O’Toole predicted that states would to look to property taxes to make up budget shortfalls. During 2011, the California Franchise Tax Board (FTB) proposed a change to Schedule CA to require the information necessary to enforce an overlooked area of the real estate tax deduction.

The real estate tax deduction applies to ad valorem taxes, the real estate tax amount based on the assessed value of a property. Taxes based on a direct levy or special assessment, such as Mello-Roos or various services provided to specific properties are generally not deductible.

However, many taxpayers are not aware of this distinction and in practice most individuals or their tax preparers include the total property tax on Schedule CA. Until recently the FTB didn’t have the capability to determine whether the reported number included non-deductible taxes, but a computer system planned for 2012 will give the FTB that capability.

The FTB had planned to enforce compliance stating this year by adding three lines to the 2011 state tax returns that would require property owners to show their parcel number, total property tax bill and the deductible amount. On November 1, 2011 the FTB announced the decision to delay the change to Schedule CA for a year and use 2012 to educate taxpayers and preparers on the rules. The board encourages voluntary compliance for 2011 tax returns and plans to enforce the rules on the 2012 Schedule CA.

As part of the education effort, the FTB created a page on their website called Understanding the Real Estate Tax Deduction that explains the rules and provides an example tax bill with the ad valorem taxes and direct levies or special assessments broken down.

For the 2011 tax year, some preparers are requiring their clients to bring in the county property tax statement before they will include the deduction in the Schedule CA.

The FTB estimates that the change will bring in an additional $200 million of revenue per year and that voluntary compliance could bring in $20 million this year.

30-Year Rates Stay Below 4%, Affordability High

Mortgage rates are staying low by historical standards, despite inching slightly higher this week following a positive job report and increasing bond yields, Freddie Mac reports in its weekly mortgage market survey.

“An upbeat employment report for February caused U.S. Treasury bond yields to increase over the week, and mortgage rates followed,” says Frank Nothaft, Freddie Mac’s chief economist. “Job growth over the last six months was the strongest since 2006.”

For 15 consecutive weeks, 30-year rates, the most popular choice among home buyers, have averaged below 4 percent.

The following is a closer look at rates for the week ending March 15:

30-year fixed-rate mortgages: averaged 3.92 percent, with an average 0.8 point, inching up from last week’s 3.88 percent average (which was only 0.01 percent above an all-time record low). A year ago at this time, 30-year rates averaged 4.76 percent.

15-year fixed-rate mortgages: averaged 3.16 percent, with an average 0.8 point, climbing from last week’s record reaching 3.13 percent average. Last year at this time, 15-year rates averaged 3.97 percent.

5-year adjustable-rate mortgages: averaged 2.83 percent, with an average 0.8 point, also slightly up from last week’s 2.81 percent average. Last year, 5-year ARMs averaged 3.57 percent at this time of year.

1-year ARMs: averaged 2.79 percent, with an average 0.6 point, rising from last week’s 2.73 percent average. Last year, 1-year ARMs averaged 3.17 percent.

This months app I can’t live without is a fun one! PandoraJam, but PC users please note – this is a Mac only app. You’ve all heard of Pandora, but what if you could get the songs playing on Pandora onto your computer, iPod and iPad?

Well now you can. PandoraJam automatically loads Pandora (and your stations), and then automatically loads them into your iTunes library! It’s the greatest, easiest and free-est way to build your music library.

I for instance wanted some early Cuban jazz, so I fired up PandoraJam, searched Pandora for “Desi Arnez” (remember I Love Lucy?), and muy rápido – I had dozens of classic Cuban jazz songs loaded onto my Mac – muy bueno!

There’s a free version and a paid version. Here’s the difference according to them.

The download is a fully-operational free trial version of PandoraJam. It is identical to the purchased version, except that recording and wireless streaming of audio stops after a few songs (but can be restarted with a click of the mouse). The restrictions are removed once the product is purchased and the associated registration information is entered in the registration dialog.
